Our Story

How Nomera came about.

Nomera began from a straightforward observation: employment matters in Malaysia are often handled either too casually — with templates that do not reflect current legislative requirements — or at a cost and complexity that is out of proportion to what the situation calls for.

The practice was set up to sit between those two points. Each engagement is approached with care, is grounded in the relevant Malaysian legislation and decided cases, and results in a written deliverable that the client can use and retain.

Nomera works from its office in Sri Hartamas, Kuala Lumpur. The location reflects a deliberate choice to be accessible to the businesses and individuals who form the bulk of the client base — companies with offices in and around Hartamas, Bangsar, Mont Kiara, and the surrounding areas, as well as employees who find themselves in a difficult position and need a clear account of where they stand.

The practice covers three main areas: employment contract and policy review for employers, disciplinary and termination advisory for both employers and employees, and a structured industrial relations programme for larger organisations that want considered ongoing support.

Every engagement produces a written advisory note or document set. Verbal discussions are useful, but the written record is what the client takes away and what holds up if a matter is later reviewed by a third party.

The team communicates in plain terms. Legal analysis is provided honestly, including an account of the uncertainties. Where a matter could go either way, the client is told that — not given false confidence in either direction.

Malaysian Employment Law

All advisory work is anchored in the Employment Act 1955, the Industrial Relations Act 1967, the Employment Insurance System Act 2017, and relevant subsidiary legislation.

Written Advisory Notes

Every engagement produces a written note or document set. The advisory note records the position taken, the analysis behind it, and the recommended next steps.

Confidentiality

All information shared in the course of an engagement is treated as confidential. Client information is not shared with third parties without express agreement.

Defined Scope

The engagement letter sets out what the work covers and what it costs. Out-of-scope work is discussed and agreed before it proceeds.

Realistic Timelines

Clients are given a realistic sense of how long the work will take. Where a matter has an external deadline, the team works to that timeline.

Personal Data Compliance

Client data is handled in accordance with Malaysia's Personal Data Protection Act 2010. Data is retained only for as long as the engagement requires.

Malaysian employment law has a layered structure. The Employment Act 1955 sets out baseline entitlements for most employees, but its scope has evolved — notably with the 2022 amendments — and the provisions vary depending on the employee's category and the nature of the employment relationship. The Industrial Relations Act 1967 sits alongside this, providing a framework for dispute resolution that runs through the Industrial Relations Department and, where conciliation does not resolve the matter, the Industrial Court.

Nomera's work draws on this legislative framework and on the decided cases that have shaped how the Department and the Court approach particular issues — procedural fairness in disciplinary proceedings, the meaning of misconduct, the proper conduct of domestic inquiries, and the standards applied when assessing whether a termination is with just cause or excuse.

Employers and HR teams who engage Nomera for policy and contract review receive a structured analysis of their documents, with clear notes on where the current drafting may not reflect the legislative requirements or may create practical difficulties. Employees who engage Nomera for disciplinary or termination advisory receive a clear account of their position and the options available to them, presented in language that does not require a legal background to understand.
